What is GST?

GST (Goods and Services Tax) is the comprehensive indirect tax charged on goods and services sold in India. It replaced VAT, service tax and excise duty in July 2017. The seller collects it from the buyer and remits it to the government.

Current rates: Since 22 September 2025, most goods and services fall into 5% (essentials) or 18% (most standard goods, services and finance). 40% applies to luxury and sin goods.

Within a state: Split equally into CGST (Centre) + SGST (State). Between states: Charged as IGST (Integrated GST).

How GST is calculated

Adding GST to a price: GST = Price × Rate ÷ 100 Price including GST = Price + GST (e.g. ₹10,000 at 18% gives GST ₹1,800, Total ₹11,800) Removing GST from an inclusive price: Price before GST = Inclusive price × 100 ÷ (100 + Rate) GST = Inclusive price − Price before GST (e.g. ₹4,999 phone with 18% GST: Base price = ₹4,236.44, GST = ₹762.56) Common error: subtracting 18% directly gives ₹4,099.18 which is incorrect because the base was ₹4,236.44.

Interest on late payment = Tax paid late in cash × 18% × Days late ÷ 365
Worked example (illustrative)
Interest on late GST payment (Section 50 CGST Act): Interest = Tax paid late in cash × 18% × Days late ÷ 365 Example: ₹50,000 paid 30 days late in cash ledger: Interest = ₹50,000 × 18% × 30 ÷ 365 = ₹739.73.

Is GST charged on loans?

Understanding where GST applies and where it is legally exempt in Indian lending.

Interest & EMIs: Exempt (0% GST)

Interest on loans, advances, and deposits is specifically exempt from GST under GST notifications. The interest component in your monthly personal loan EMI attracts 0% GST.

Processing Fees: Taxed at 18% GST

Administrative charges, processing fees, document verification fees, and loan origination charges are treated as financial services and attract 18% GST.

Penal Charges: Exempt (CBIC Jan 2025)

As clarified by the CBIC in January 2025, penal charges levied by RBI-regulated banks and NBFCs for delayed EMI payments do not attract GST.

Credit Cards: Taxed at 18% GST

Credit card finance charges and conversion interest are explicitly excluded from the interest exemption. Therefore, 18% GST applies to credit card interest and fees.

Which GST rate applies?

Classification criteria determining applicable GST slab.

HSN / SAC Code

Goods use HSN codes and services use SAC codes which fix the statutory tax rate.

Essential vs Sin goods

Essential items attract 5%, mainstream goods 18%, and luxury/demerit goods attract 40%.

Sale location

Location decides whether tax divides into CGST + SGST or combines into IGST, though total rate remains identical.

Invoice date

Bills dated prior to 22 September 2025 may reflect discontinued 12% or 28% legacy slabs.
